There is a growing number of people in Oklahoma pushing back against the idea that marriage lawfully exists between other than a man and a woman. We are working to get a resolution passed to reverse the federal Supreme Court ruling (Obergefell v Hodges in 2015) that recognized same sex marriage. In our opinion the ruling should be overturned and promptly returned to the states as was Roe v. Wade recently.

Here is a letter that Eddie Collins, a state committeeman from Washington County, wrote recently to Senator Julie Daniels. She failed to help bring the resolution to the floor for a vote last session but we are hoping she will do better next session. You will see a list of other senators that need to be contacted on this matter below this letter. Please help in any way you can with communicating the urgency of this matter to your elected representatives! While the matter is currently in the senate, it would be nice if our house representatives were insisting on passage of this resolution in the senate, so feel free to contact them as well!

On July 8th I spoke with you regarding the unanswered emails (June 3, June 24, July 7) I had sent to you regarding SCR8, as to why it was never allowed to go to the senate floor for a vote, while it had 25+ endorsers/supporters signed on. (For your information I had also contact Senate Pro Temp Lonnie Paxton via email without any response as well.) You stated that you had checked with some of your NGO legal consultants and that there were no active legal items in the judicial pipeline. After our meeting, I have done additional research and found that statement to be untrue as I will explain.

Earlier this year (April 2025) Liberty Counsel asked the U.S. Supreme Court to review former Rowan County Kentucky Clerk Kim Davis’ case regarding whether the First Amendment shields her from liability and damages for refraining from issuing a “same-sex marriage” license against her religious beliefs. The full Sixth Circuit Court of Appeals recently denied Davis’ request to rehear her case after a three-judge panel affirmed the jury verdict against her. However, the appeals court indicated this is potentially a case of “first impression,” meaning that Davis’ case presents a novel or unique question of law for which the courts have not settled on an answer. The case raised the question of whether a government official sued, in an individual capacity and stripped of governmental immunity, may assert a personal First Amendment defense to monetary damages. Davis’ lawyers are attempting again to get her case before the Supreme Court. By taking the case, SCOTUS can answer the question of “first impression,” resolve any conflicts with Supreme Court precedent, and ensure that former government defendants standing before the Court in their personal capacity do not lose First Amendment protections. The passing of SCR8 in May by the Oklahoma legislature would have been perfect timing to opine on Obergefell vs Hodges before the Supreme Court on this important issue.

As a matter of fact, just recently the Southern Baptist Convention (SBC) did just that and passed a resolution urging the Supreme Court to overturn Obergefell v. Hodges, the 2015 case that invented a so-called “right” to same-sex “marriage” out of thin air. The SBC’s timing was perfect because this was the 10th anniversary of Obergefell and Liberty Counsel is preparing the Kim Davis case for U.S. Supreme Court review. Liberty Counsel will ask the High Court to overturn the Obergefell opinion that created this mess.

Further, at least three sitting Supreme Court Justices (which includes Chief Justice Roberts) expressly wrote that the Obergefell opinion has no basis in the Constitution. In his 2015 Obergefell dissent, Justice Alito warned that Obergefell “will be used to vilify Americans who are unwilling to assent to the new orthodoxy.” Chief Justice John Roberts himself laid out the case against the Obergefell decision quite well in his dissent, declaring that “five lawyers” invented a right that upends centuries of law and objective reality from nearly every corner of the planet, and they unconstitutionally superseded states’ rights. In his dissenting opinion, Chief Justice Roberts noted, “Under the Constitution, judges have power to say what the law is, not what it should be.” Yet the “five lawyers,” the Chief Justice wrote, “enacted their own vision of marriage as a matter of constitutional law.” “The majority’s decision is an act of will, not legal judgment,” Roberts wrote. “The right it announces has no basis in the Constitution or this Court’s precedent.”

Even Justice Thomas joined in saying that believes the exact same legal precedent that overturned Roe should also overturn Obergefell. “In future cases, we should reconsider all of this Court’s substantive due process precedents, including Griswold, Lawrence, and Obergefell,” wrote Justice Thomas. “Because any substantive due process decision is demonstrably erroneous.” “[W]e have a duty to “correct the error” established in those precedents,” Justice Thomas continued.

I believe that passage of SCR8 by Oklahoma would add significant weight to SCOTUS taking up the case. As American citizens, a Republic founded on Biblical principles under the U.S. Constitution, and as Christians believing God’s laws, we believe that marriage is only between a man and a woman as instituted by God himself and that the high court errored in its 2015 decision under Obergefell vs Hodges, just as it had previously done under Roe vs Wade, which has subsequently been reversed.

As an American citizen, a citizen of Oklahoma and your constituent I am requesting that SCR8 be presented to the Senate floor for vote. In my opinion, Oklahoma should be leading the charge, not waiting to follow the lead of others! We should boldly stand for Godly and legal principles!
